Bio

Brian is one of New Zealand’s most senior and respected litigators, commercial negotiators and dispute-resolution experts.

His commercial focus is currently front-line advocacy on large and complex cases, most recently the nine-week High Court trial of Green & McCahill Holdings Limited v E C Williams & Ors. Brian’s commercial litigation practice is wide ranging in subject matter and legal issues and usually concerned with the pointy end of disputes.

The Coalition Government has appointed him Chief Crown Negotiator for Treaty of Waitangi claims in respect of Ngāpuhi and Hauraki claimant groups, and he advises other iwi on commercial and land-related matters.

Before joining Bankside, Brian was Crown Solicitor at Auckland, overseeing the prosecution of serious crime in the region, and personally leading those prosecutions of particular national or regional significance or interest.

After his first High Court trial aged 23, he has led many high-profile homicide prosecutions for the Crown including the Grace Millane murder trial in 2019. For regulatory authorities, he conducted very challenging prosecutions and civil liability cases concerning complex white-collar crime and large-scale commercial and market fraud, particularly following the Global Financial Crisis. Some of these cases attracted very significant national and international attention such as the Bridgecorp directors’ case, requiring careful management.

Since joining the Bar, Brian has enjoyed success at the Court of Appeal on high-profile Electoral Act ‘fraud’ cases acting on behalf of individuals charged by the SFO.

Brian’s whakapapa includes Waikato-Tainui (Ngāti Maahanga) and Croatian ancestry. He has been a member of the Serious Fraud Office panel of prosecutors since 2010 and is patron of New Zealand Police Recruit Wing 321.
