Jason is a highly experienced advocate sought after to lead complex commercial cases. He practices across the full range of commercial litigation, but has particular expertise in banking and finance, securities, insurance, insolvency, professional negligence, trust and property disputes.

Jason is recommended as a leading silk in the major legal directories, where he has been described as “outstanding”, “exceptionally intelligent”, “incredibly articulate” and “unflappable in court”. He is also noted for his “excellent commercial judgement” and “outstanding legal mind”.

He has acted for numerous public companies, large corporations, insurers, government agencies, local authorities, and high net-worth individuals. He has also acted for clients in most of New Zealand's largest class action cases in recent years, including the CBL, Southern Response, James Hardie, Intueri and Toyota class actions.

Jason graduated from the University of Auckland in 2003, placing second in his year and receiving numerous prizes. He clerked for Sir Peter Blanchard in the Court of Appeal and then worked as a commercial litigator at Russell McVeagh and Slaughter & May (London). He moved to the independent bar in 2010 upon his return from London and took silk in 2022. He has presented numerous papers at law conferences and is an editor of leading texts on property law, including Hinde McMorland & Sim Land Law in New Zealand.

CBL litigation (Current)

Lead counsel for the liquidators of CBL Corporation in one of New Zealand's largest corporate insolvencies. The proceedings involve claims of around $900 million. Jason is defending CBL in two shareholder class actions and claims brought by the Financial Markets Authority and is representing the liquidators in claims against CBL's directors.

‍Acting for Westpac in a $50 million civil fraud claim.

Bank of New Zealand v George Kerr & Others (Current)

Acting for high-profile investor George Kerr in the defence of a $65 million claim by the Bank of New Zealand.

Pyne Gould Corporation v Bath Street Capital (2021)

Acting for publicly listed Pyne Gould Corporation in a $22 million claim against Bath Street Capital relating to a financing dispute, which settled in 2021.

Energy Securities LP v Vector Limited (2019)

Defended the publicly listed utilities company Vector in a securities claim.

Ngāti Whātua Holdings Ltd v Jordan & Ors (2019)

Acted for the board of directors of a major fisheries company to successfully resist an injunction preventing the sale of a $90 million business.

Apia Construction & Engineering Ltd v Samoa National Provident Fund (2017)

Defending a substantial construction arbitral award against the Samoan Government from challenge.

BDL v CB (Sir Bernard Rix, Hon. W Brazil, N Kaplan QC, 2017)

Acting with American attorneys for a New Zealand distributor in an international arbitration appeal held in California.
